Never has a Malaysian By-Election been so nationaly important than the one to be held in Permatang Pauh, tomorrow, Tuesday 26th August 2008.


It is a Public Holiday in the state, so no excuse for there not being a good turn out of voters.
So all voters should exercise your democratic right and go to vote.



Reject the BN money politics, bribery in cash and kind and all other devious inducements offered by the BN.


Reject BN intimidation, lies, deception and thuggery.


Reject UMNO / BN's Arif Shah, who has been shown to be a devious and unworthy candidate.



Ignore Saiful's video and sportman Lee Chong Wei who was roped in, against his will, by the desparate BN to try to boost its flagging popularity.

So reads the ‘pantun’ (Malay poem) printed on the banner which is hung alongside the railway tracks by the side of the main road in Kubang Ulu, Penanti, an area regarded as a stronghold of Parti Keadilan Rakyat (PKR) de facto leader Anwar Ibrahim.

The banner [courtesy of PKR’s Bandar Tun Razak division?], refers to Pakatan Rakyat’s assured position that the Permatang Pauh parliamentary by-election an initial formality and that Anwar’s return to Parliament will thereafter lead to Pakatan Rakyat’s (People’s Coalition) eventual take over of the Federal Government of Malaysia.

PERMATANG PAUH BY-ELECTION, MAFREL PRESS RELEASE dated 22nd AUGUST 2008

Permatang Pauh By-Election- Some Information

MAFREL, as a non-partisan election watch group started since 2003, has started its election watch mission to the by-election at P.44 Permatang Pauh since it was given Election Commission/SPR’s official accreditation on Aug 7th. Kol( R )Shaharuddin Othman was appointed as Mission Head while Ong Boon Keong, the MAFREL’s Northern Region Coordinator, was the Director of the Election Observation Mission, to spearhead the Observation Mission. Around 100 volunteers have been recruited thus far and MAFREL target to recuit 150 volunteers in all, so as to put enough scrutiny on the polling, which will take place over 28 Voting Centres and 110 voting stations on Aug 26th. MAFREL therefore welcome more volunteers to come forward to join the citizens’ movement for free and fair elections. Such mobilization is also justified by the well-acknowledged importance of the by-election at Permatang Pauh.

Findings so far:

Electoral Rolls Verification(ERV):

1. The electoral rolls to be used for this by-election is dated July 31st, while the last gazzetted electoral roll is dated June 19th. This is a notable departure from accepted practice to use only duely gazzetted electoral rolls for election. Enquiry from EC suggest that those voters who are found to have died or applied to move away, have been removed from the gazzetted roll to create the roll to be used for the by-election. The noted haste has disallowed normal public scrutiny into the amendments to the rolls. Specifically there is an inexplicable deletion of all 25 centurion voters from the gazzetted rolls. Have they been properly checked before that happen? A lack of transparency is also reflected by the refusal of the EC to upload the last quarterly supplementary electoral rolls to the EC official web site for overall, national scrutiny of the rolls.

2. Postal votes: All the 490 postal votes for Permatang Pauh are from the police personnel in the area. However the inclusion of a new District police HQ (Ibu Pejabat Polis Daerah Seberang Prai Selatan) from Bkt Mertajam into Permatang Pauh Parliamentary area smack of Gerry Mandering way to unfairly influence the voting pattern in Permatang Pauh. The police station has 321 postal voters, accounting for 65% of the total postal voters in Permatang Pauh.

Implications:

1. The postal votes in Permatang Pauh only numbered 91 before the 2004 General Elections, where the BN candidate came within 590 votes to unseat his opponent, the PKR president. The addition of this new batch of postal votes after the General Elections seems calculated to finish the job for the candidate in the following election.

2. While the political tsunami on Mar 8th rendered any possible calculations with the postal votes irrelevant the 405 postal votes introduced by the police stations actually have been noted by a number of sources as having come to the rescue of the current candidate who won his state seat by a mere 553 votes.

Election Campaign Observation( ECO):

3. MAFREL observers have been assigned to monitor the campaign activities of all the candidates and found that the election campaign is full of violations on a daily basis. A Daily Election Index(DEI) is compiled and posted on the official web site of MAFREL ( http://mafrel.wordpress.com ) for this by-election to remind the candidates/parties of the violations of the rules on free and fair elections and the dire penalties that come from the law ie Election Offences Act 1948. The non-enforcement of such laws only serve to encourage the proliferation of illegal campaign activities, Permatang Pauh not excepted.

Election campaign activities which impinge of the freedom to vote include: violence and threat of violence to voters, candidates and the media-either through (suspected) campaign workers or the use of excessive intimidating police presence.

Election campaign activities that compromise fairness of elections include: abuses of public buildings, staff (especially police), functions, media; treating the voters and also the offerings of various types and under various disguises to the voters.

All such activities could combine to render the election results questionable and cast the winners’s legitimacy into doubt.

Appeals:

1. MAFREL therefore renew its call for the use of indelible ink to stop possible election frauds through impersonation and multiple voting;

2. MAFREL calls upon the EC/SPR to expand the scope of MAFREL’s accredited activities from the current restrictive `observation’ status to the freer `monitoring’ status; MAFREL also call upon EC/SPR to consider allowing enough observers to cover all voting streams instead of the current single observer who may need to observe several voting streams in a voting centre at the same time, from morning till the evening! Observers should be allowed free movement between polling centres/stations so as to allow observers to work more effectively;

3. EC should either clean up the electoral rolls or it should drop its own roll compilation and adopt the National Registration Dept’s better roll; This will also save huge amount of time and energies which can be put to better use elsewhere to improve the election system;

Lastly MAFREL wish to point out that every citizen has the right to vote in free and fair elections. There must not be threats, no undue influences, no buying of votes etc. MAFREL call upon anyone who witness any election offences to contact us immediately to facilitate actions and documentations. The 12th Malaysian General Election pits Prime Minister Abdullah Ahmad Badawi's long-ruling Barisan Nasional (BN) coalition against three main opposition parties, the Democratic Action Party (DAP), Parti Islam se-Malaysia [Islamic Party of Malaysia] (PAS) and Party Keadilan Rakyat [People's Justice Party] (PKR).

Abdullah Ahmad Badawi is asked, by Riz Khan, about rising prices, growing ethnic tensions and whether or not he can maintain a two-thirds parliamentary majority.

Tomorrow, Saturday, 8th March 2008, is the day to cast your votes, which candidates you vote for in the Parliamentary and State Legislature contests are your own personal choice, but please think very carefully before you vote.

Make sure you know the implications of voting either for the BN or for the opposition.

The Main Steam Media, which includes the newspapers, the Radio & TV channels and Malaysia's monopoly satellite broadcaster ASTRO, which censors everything, so much so that even the live news, is delayed by several minutes, has been full of BN bullshit.


The opposition parties have had no air time at all, and virtually zero space in the editorial part of the English and Malay Language newspapers (any coverage they have had has generally been negative), the Chinese Language press has been fairer, and has had articles about, and paid advertisements from opposition political parties.


The BN has ruled the roost authoritatively for the past 50 years, they have amended the Malaysian Constitution, as and when they deemed fit, no less than 690 times in that time (nearly 14 times per annum on average), and the motive for these changes has, on the whole, been solely to strengthen the BN's grip on power.

UMNO dominates and rules BN, the other component parties are mere onlookers, silent partners, yes-men and toothless goons like the guy, with hairy lips and foul breath, at the top of the page.

Billions of Ringgit have been frittered away, squandered, wasted, syphoned off and as you all no doubt know, bribery and corruption are so deeply embedded, that they can be found in all tiers of administration.

Malaysia, given the wealth of natural resources, inherent expertise and experience, should be already a well developed country, but instead is a nation which has some of the features and trappings of a developed country, but is essentially still largely undeveloped as far as education, freedoms, democracy, human rights, public services, fair distribution of wealth, education, sustainable development and care of the environment are concerned.

Many citizens are still stricken with poverty, suffering by having to live hand to mouth, eking out their lives one day at a time.

The bulk of the wealth is with a very small percentage of the population, the remainder are neglected, patronised, subsidised (with their own money), and truly marginalised.

WHY BN MUST NOT GET A TWO THIRDS MAJORITY AGAIN

It outlines why the greatest effort of all Malaysian voters is needed just to deny BN its 2/3 majority.

It would be almost a miracle to achieve this goal, nevertheless, everyone should vote to try to achieve this miracle and deny BN a 2/3 majority.

HERE ARE THE REASONS WHY THE VOTERS SHOULD NOT GIVE BARISAN NASIONAL (BN) A 2/3 MAJORITY IN PARLIAMENT

1. BN lost their 2/3 majority only once, in 1969, but for a very brief period.


2. Since 1957, BN has amended the constitution 690 times solely to propagate its power.


(By comparison, USA which is more 200 years old has only amended its constitution 27 times; while Singapore amended its constitution only 4 times.)


3. BN's ability to amend the constitution as and when it likes (and thereby make unjust and unfair constitutional changes) must be stopped. The only way to achieve this is to deny them a 2/3 majority in Parliament.


Here are some statistics from the 2004 election:

1. UMNO received 35.9% of the popular votes but had 110 parliamentary seats or 50% of all parliamentary seats.

2. In total, BN received 63.8% of the popular votes but had 199 parliamentary seats or 91% of all parliamentary seats.

3. The opposition received 36.2% of the popular votes but had only 20 parliamentary seats or 9% of all parliamentary seats.

Why?

Because of gerrymandering (check the dictionary: it means interfering with an election, by, for example, dividing voting districts so as to give unfair advantage to one party in elections) , or having unfair election rules.
The election rules are stacked against the opposition.
No matter what happens, the opposition may never be able to win the next election.
BUT WHATEVER THE ODDS, THE VOTERS MUST NEVER GIVE UP THE FIGHT VIA THE BALLOT BOX.

The decision-making power process within the last cabinet, was like this:

1.. UMNO not only controlled the parliament via Barisan Nasional, it also allocated itself 24 cabinet positions which equates to 71% of all cabinet positions.
2. MCA had 5 cabinet positions or 15% of the cabinet positions.
3. MIC had 1 cabinet position or 3 % of the cabinet positions.
4. Gerakan had 1 cabinet position or 3% of the cabinet positions.
5. Other component parties held 3 cabinet positions or 8% of the cabinet positions.

One should take note that although UMNO controlled only 50% of all parliamentary seats, it controlled 71% of all the decision making processes within the cabinet.

Many marginalization issues or unfair election practices are the result of legislation passed, or amended by the BN government, (lead and totally controlled by UMNO), and which is completely unchecked in the BN dominated Parliament.

Under the BN party whip system, the majority component party within BN dictate the rules of the game. Other BN component parties like MCA, Gerakan or MIC cannot vote against whatever UMNO decides, even if they wanted to.

5. Best of all for BN is the fact that even if the opposition won 50% the seats it contested, the opposition parties may still not be able to form the next government.

Why?

Because gerrymandering (of the present election borders) has ensured that even if BN were to win 50% of the popular votes in the upcoming election, it will still control 2/3 of parliament.

As an example, in 2004 BN took 64% of the popular votes but ended up controlling 91% of parliament. (see table below)

It is easy to see why if they win only 50% of the popular votes in the next election they will once again be able to dictate and hold absolute power in the parliament. Do your maths … and do your part… for our children and our future! The target has to be high, so vote for change of government.

Then there is also the possibility of voting irregularities, such a multiple voting, phantom voters, ballot box stuffing, vote tampering, ballot paper frauds, etc., etc., etc.

PUTRAJAYA: The Election Commission has cancelled the use of indelible ink in polling this Saturday, citing public order and security reasons.

Its chairman Tan Sri Abdul Rashid Abdul Rahman said following a meeting held Tuesday, the EC was obliged to make a firm and final decision to ensure the smooth conduct of the 12th general election.

He said provisions to the law needed if the ink was to be used still could not affect the constitutional right of a voter to cast his vote, even a person whose fingernail had been marked with indelible ink or one who refuses to have his or her fingernail marked this way.

"From a practical point of view, the issuance of a ballot paper to such a voter would render the EC's proposal meaningless and will not bring about a positive result, whilst having the potential to create misunderstanding as well as altercations and arguments at polling stations," he said.

The Federal Constitution gives you the right to vote, and a black mark on your fingernail should not bar you from exercising this right, he said.

Abdul Rashid said there were also reports made to the police confirming that certain irresponsible quarters had purchased indelible ink from abroad with the intention of creating confusion and suspicion as to the status of voters.

"The EC views these issues seriously as the election process and public order and security cannot be compromised," he said.

The use of indelible ink was first proposed last June to safeguard against multiple or phantom voting. Abdul Rashid then said that the system would be subject to amendments to the Election (Conduct of Election) Regulation 1981.

He said indelible ink had been chosen over other measures, such as a biometric system working off the MyKad (chip-based identity card carried by all Malaysians above the age of 12) because such such smartcard readers would have cost about RM60,000 each, and every voting stream would have to be equipped with one. Using such a system would have cost in excess of RM30mil. The commission bought about 47,000 bottles of the indelible ink, manufactured in India, for RM2mil.”

“Police Uncover Attempt To Create Confusion During Polls

PUTRAJAYA, March 4 (Bernama) -- Police have uncovered an attempt by some irresponsible people out to create a confusion during Saturday's elections by having voters dipped their fingers in indelible ink before the polling day.

Inspector-General of Police Tan Sri Musa Hassan said four individuals had lodged police reports alleging that there were people buying such ink from overseas and planning to persuade misinformed voters to use it before the polls.

One report was received in Kelantan, one in Kedah and two in Perlis from Feb 16 to 21, and police had classified them as attempted cheating, he told reporters here today.

He said the allegation was found to be true but so far, no arrests had been made as the police were still identifying the people involved based on the statements recorded from by the complainants, aged between 30 and 50, who were traders and self-employed.

Asked whether the complainants were from political parties, he said: "I don't know but they are locals."

When asked how soon the case was expected to be solved, he said: "I am trying to get all the assistance on this.

"We have interviewed the individuals. We want to know where they obtain the information."

He said police were also trying to ascertain where the ink came from.”

THE PLOT THICKENS

What is going on?

This all sounds rather fishy, it seems that something else stinks in the State of Malaysia.

Does the BN consider that there is a risk of it losing the magical 2/3 majority?

Is this a last minute ploy to enable phantom voters to vote, so that the votes for BN can be padded?

There will now be serious doubts that the Malaysian General Election on Saturday 8th March 2008 will be free and fair.

There is now a greater possibility that voting for both the Federal Parliamentary and the State Legislature Elections will be more easily gerrymandered.
