Judge rules that Anwar's sodomy case arguments to be heard in Sessions Court

Sessions Court judge SM Komathy Suppiah ruled against the prosecution's application to transfer Opposition leader Anwar Ibrahim's second Sodomy trial to the High Court. She will hear arguments regarding the application in the afternoon.

The judge said that the lower court has the jurisdiction to hear the case, regarding the transfer to a higher court, her decision is a significant victory for Anwar's defence team.

Anwar had objected to the application to transfer the case to the High Court because it was made by the Attorney-General Abdul Gani Patail, who has been accused by Anwar of evidence tampering in an earlier case.

Anwar, a former Malaysian DPM is charged with sodomising his former aide Mohd Saiful Bukhari Azlan.

The honourable judge has upheld the cause of justice in Malaysia, this is indeed a spark of hope.

Justice, democracy and human rights, which are sorely lacking under the UMNO / BN federal government, are still being kept alive until the new Pakatan Rakyat (Peoples Alliance) federal government comes to power.

UPDATE

The sessions Court will resume on Wednesday, 8th October 2008, at 11:00 when the defence will continue submissions objecting to the transfer of the sodomy case to the High Court.

Shameful third-world detention facilities in Kuala Lumpur

"My two girls and I managed to see RPK at 11:00am this morning (16 September) at the Bukit Aman Police HQ.

He has been sleeping on a wooden platform without any pillow or bedding. He looked drawn and drained but still alert.

I started informed him that the support he has at home and abroad is keeping us strong and that should be enough for him too to continue to be strong. I also told him that the Pakatan Raykat has the numbers to form the next government and it is just a matter of time that we would soon get him out.

He has lost weight and his sugar level has dived from 8 to 4. I urged him to eat and to drink a lot of water. In fact we brought him his favorites: a 6-pack coke, chocolates, fresh plums, shepherd’s pie and caramel custard. Raja Petra asked us to take them back. He said that those interrogating him would try to use these food items as inducements to get him to co-operate. RPK said he did not want to be beholden to them. They will use favours they grudgingly grant and use these as trade offs.

He complained that the food supplied is such that our two cats will not even eat. But I encouraged him that despite that, he has to eat. He replied that he has no appetite and that most of the time he is tired as they are interrogating him incessantly. They come to his cell (8X8 concrete box without windows) and harass him at all hours of the day and night taking hourly turns having a video camera at all times. One time they brought a prayer mat and the Koran to his cell and just said so you don’t want this and took it away recording all this.

Sometimes they just come to the cell every half hourly to peep into his cell with the loud clicking of the peep hole keeping him awake. They are interrogating him on all his articles and at this stage it is on his articles on Islam. They said he has no right to write about Islam because we (his family) don’t live like Muslims and they were not sure whether we prayed or not as how all good Muslims should.

During our visit a video camera was trained on us all the time that I was with RPK. There were always two officers in the room with us for the whole duration. When an officer came in to tell us that we had 10 minutes left, I took the opportunity to brief him on all the happenings related to his being in the ISA...

Teresa Kok arrested; the reporter arrested and then released after 16 hours; the candlelight vigils at Bukit Aman, Bloghouse and Dewan Sri Penang. I told him that he has made history on the ISA issue that the even the Barison Nasional component partners, Gerakan, MCA, PPP and some Ministers and even Zaid Ibrahim has resigned over the wrongful use of the ISA, about the awesome crowd at Kelana Jaya Stadium last night and about the Free RPK banners around the stadium and how the crowd of about 20,000 chanted ‘bebaskan RPK’ .

I also told him that I was going to the lawyer’s office after our visit to file habeas corpus and to Datuk Seri Anwar Ibrahim’s Press Conference at 2pm on the cross overs.

I informed him that our team of lawyers will be seeing him on Thursday at 11am, but the police called my lawyers in the afternoon and changed the time to 10am tomorrow."

How shameful that the police detain people in inhuman conditions, is this the Islamic way?


Malaysia certainly is still well and truly a third-world banana-republic, where there is zero respect for human rights, very limited freedom of speech, no freedom of assembly or expression.


Detainees are intimidated, tortured and abused in 21st century Malaysia.

How shameful this is!

When the new government under Pakatan Rakyat takes over, there needs to be urgent legal reforms to do away with such abuses of power.

MALAYSIA DAY 2008, HAPPY 45th BIRTHDAY MALAYSIA

Anwar Ibrhaim arrived at the mass rally held at the Kelana Jaya Stadium last night to cheers and rapturous applause from an estimated 15,000 to 20,000 supporters who had gathered at the stadium which echoed to chants of 'Reformasi' (‘Reform’) from 19:00 hours.

The turn out was splendid and spontaneous, there was none of the ‘rent-a-crowd’ tactics, usually used by BN, when thousands of folks are 'employed' and bused-in to boost the numbers their events.

All of those attending were sincere and they represented many millions of people across Malaysia who were unable to attend.

Opposition leader Anwar Ibrahim told the assembled crowd, that he had the numbers to form a new government and wants to meet with P M Abdullah Badawi to discuss a handover.

Very soon Malaysia will have a new government, of all the people, by all the people and for all the people.

PR MASS RALLY TONIGHT AT KELANA JAYA STADIUM


Pakatan Rakyat (Peoples' Alliance) has announced a mass rally in a show of solidarity for Raja Petra Kamaruddin and DAP MP Teresa Kok now being held under the Internal Security Act (ISA) and to demand their release.

The police have issued a permit for this rally (under repressive laws in Malaysia all gatherings require a police permit)

The rally will be peaceful, but the organisers and those attending will need to be aware that there may well be agents provocateur mingling in with the crowd, troublemakers from the political and perhaps the religious lunatic fringe, who may try to stir up trouble. It is not too far fetched to postulated that the some agents provocateur may be from groups within the Barisan Nasional, or even the police themselves? Anything is possible!

But let us hope that there will be no trouble makers, and that the rally will proceed in an orderly and peaceful manner.

The rally is being held tonight (Monday 15th September 2008) from 19:00; the eve of Malaysia Day (16th September) which is opposition leader Anwar Ibrahim's self imposed deadline to take over the government through defections of MPs from the ruling BN coalition.

The opposition alliance said it expected some 30,000 supporters to gather for the rally in Kelana Jaya stadium on Monday night to call for the release of the two still detained, after the journalist was freed Saturday.

It will be held on the eve of September 16, Anwar's deadline to seize power and also the day in 1963 when Sabah and Sarawak joined together with Malaya to form modern Malaysia.

"We gained independence but Malaysians continue to live under repression. We believe Malaysia Day should symbolise freedom, justice and equality," said PKR information chief Tian Chua.

"The gathering at Kelana Jaya stadium is to express our solidarity for the two people held under the draconian security law and to demand their freedom," he told AFP.

Rights groups have condemned the use of the Internal Security Act (ISA), which allows for indefinite detention without trial, and the United States summoned Malaysia's top envoy in Washington in protest over the arrests.

She was released Saturday after a one-day detention under the Internal Security Act (ISA).

WHY THE HELL WAS SHE ARRESTED UNDER THE ISA IN THE FIRST PLACE?

The next week or so will be busy for Anwar Ibrahim, his sodomy trial opens on Wednesday and the political coalition he leads, Pakatan Rakyat is certain to seize control of federal government on, or about, 16th September 2008.

The hijacking of some BN back-bench MPs to Taiwan, and possible ‘monetary political inducements’ whilst they are there may cause a slight delay, but fear not, sources high in PR have clearly stated that they have the required number of MPs who will definitely defect from BN to PR.

Soon after the BN, enforced compulsory holiday and incentive, tour group return from Taiwan, there will be an announcement from PR that the majority of Malaysians are eagerly awaiting.

“THE END OF THE UNMO / BN FEDERAL GOVERNMENT”

After his landslide victory in Permatang Pauh, enabled his return to Parliament after an absence of a decade, there is no stopping Anwar, the former deputy prime minister in the lead-up to 16th September 2008.

Now that Joseph Kurup is no longer a BN MP* after his election was declared ‘nul & void`, therefore as of now, BN has only 139 MPs compared with Pakatan Rakyat's 82, so to obtain` a simple majority, PR only needs another 29 MPs.

*[Joseph Kurup is no longer a deputy minister following the Kota Kinabalu High Court’s decision to declare null and void his election as the unopposed winner of the Pensiangan parliamentary seat.

DPM Najib Razak said on Monday, 8th September 2008, that a deputy minister must come from among members of parliament.]


The maths is simple: Total MPs 222

BN currently (8th September 2008) has 139 MPs, when BN loses 29 by defections it will be left with only 139-29 = 110 MPs

PR will then have 82 + 29 = 111 MPs


So on, or soon, after '916' (16th September 2008) Pakatan Rakyat will have control of the federal government of Malaysia.

Over 40 BN will cross over, 12 days to go before 16th September 2008, Malaysia Day

ANWAR WILL DISMANTLE THE NEP DISCRIMINATION

The leader of the opposition coalition in Malaysia Anwar Ibrahim, who himself is a Malay, said on Tuesday 2nd September 2008, that he would, if he comes to power in Malaysia, which is a multi cultural, multi religious and multi ethinic country, dismantle controversial discriminatory policies primarily benefiting the Malays

He said he would do this by replacing the New Economic Policy (NEP), which was initiated in the early 70s, with a new system which would boost the income of all poor Malaysians, irrespective of their race or ethnicity, the majority Malays and other ‘bumiputras’ and the minority Chinese, Indian and other communities would all be on an equal footing.

"We will do everything in our power and disposal to help and assist the poor and the marginalised, which means the vast majority of the Malays and the poor Chinese and the poor Indians, but we do it on a needs basis" Anwar said.

The NEP was launched in 1971, two years after racial riots broke out on 13th May 1969, it was an effort to try reduce the then wealth disparity between the Chinese, who then controlled most of the business sector and the Malays, who dominated the government (civil service) sector.

However critics of the NEP say it has generally failed and that the prime beneficiaries have been mainly alrerady rich Malay entrepreneurs (political cronies) who have taken full advantage of a vast range of benefits, including discounts on property purchased and very easy access to specially allocated government projects, APs etc.

Anwar promised to abandon the controversial Approved Permit (AP) a scheme for the licensed import of cars, which it is claimed, by many, to have corruptly enriched a small number of well connected Malay entrepreneurs.

"Those talking about Malay dominance would realise that the AP is a classic case where the Malays and the Malay name has been abused, raped and plundered by the few" he told a press conference.

Anwar, a former deputy prime minister and finance minister was sacked and later tried and jailed a decade ago, has vowed to displace the government with the help of defectors from Barisan Nasional component parties by 16th September 2008.

Anwar has accused embattled PM Abdullah Badawi of ‘spending his way out of trouble’ with a 2009 budget packed with perks and tax cuts, and he said, if he comes to power, he would reduce the projected 2008 budget deficit of 4.8 per cent of GDP.

"I suspect Abdullah feels that his days are numbered, so he spends as much as possible because he knows the next government has got to deal with the debts," he said.
