Sodomy charges are 'Pathetic' Anwar Ibrahim says

Malaysia's opposition leader Anwar Ibrahim calls the sodomy charges against him 'pathetic' but he says the opposition is making plans for the future should he be convicted or die.

Anwar told this to an audience on Monday 5th October 2009 at Johns Hopkins' School of Advanced International Studies in Washington DC, USA, saying that there is no evidence to support charges that he sodomised a 24-year-old male former aide last year.

He also said in a news report, that Malaysia is dealing with 'semi-authoritarian rule' and therefore the opposition must plan for a possible conviction or his death.

Anwar also said, Malaysia must also shake off 'race-based politics' and move to a true democracy.

Mega Rally Planned for Wednesday 8th July 2009 at the Kuala Lumpur court complex

Anwar Ibrahim's Sodomy Trial, Latest News


Abdul Gani Patail, who is now Malaysia's Attorney General, is accused of trying to hide facts in the investigations into the shameful Anwar Ibrahim assault, better known as "the black eye incident".

This allegation was contained in the statement of claim filed by the then investigating officer of the case, Mat Zain Ibrahim, (who is now retired) was the Kuala Lumpur Criminal Investigations Department chief, and he was responsible for finding out who had assaulted and given Anwar a black eye). and tendered as an exhibit, in the Anwar Ibrahim sodomy case, it was read out by Anwar's lawyer Sulaiman Abdullah last Wednesday.

The statement alleged that Gani, who at that time was a senior deputy public prosecutor, had hidden facts of the investigations (tantamount to tampering with evidence?) from the then Attorney General Mohtar Abdullah.

Mat Zain also alleges that Gani had attempted to delay the investigations, whilst he (Mat Zain) was trying to complete them as soon as possible.

Mat Zain has claimed that Gani was present on the 39th floor of the Federal police HQ at Bukit Aman. Kuala Lumpur, on 20th September 1998, when Anwar was badly beaten by the then Inspector-General of Police, Abdul Rahim Noor.

He stated that he had submitted his investigation papers (IP) to Gani on 30
th October 1998, but one week later, the AG had issued a press statement claiming that neither he, nor any of his officers, had received the IP.

However, the AG's chambers confirmed they had received the IP on 20
th November 1998, only after Mat Zain had insisted that Gani confirm this fact.

On 6
th January 1999, the chambers concluded that Mat Zain's investigations were incomplete thus they could not identify who had assaulted Anwar.

Nevertheless, eventually, the then Inspector General of Police, Abdul Rahim Noor, was charged, on 23
rd April 1999 with assaulting Anwar Ibrahim, he subsequently pleaded guilty and was sentenced to two months imprisonment and was also fined RM2,000.

Anwar Ibrahim's Sodomy Trial, Gag Order Lifted

After submissions by the defence lawyers, the Kuala Lumpur Sessions Court has lifted a gag order against publishing details of Attorney-General Abdul Gani Patail’s alleged involvement in tampering with evidence in Anwar Ibrahim’s trial 10 years ago.


Anwar has filed an affidavit to support his application opposing the prosecution’s bid to transfer his case from the Sessions Court to the High Court.


He had questioned the validity of the transfer certificate signed by AG Abdul Gani Patail when under an Anti-Corruption Agency (ACA) investigation following a police report lodged against him by Anwar over fabrication of evidence.


Anwar’s lead counsel Sulaiman Abdullah had argued before Judge S.M. Komathy Suppiah that the three exhibits [two statements of claim respectively filed by Inspector-General of Police Musa Hassan and the then investigation officer in the 1998 Anwar case Mat Zain Ibrahim and newspaper reports on that incident] had been read out in open court.


The two statements of claim were filed in the Kuala Lumpur High Court and they become public documents and they could be published. The public has the right to know what had happened in court,” Sulaiman said.


Anwar had suffered a black eye in 1998 after he was allegedly punched in the eye by former Inspector-General of Police Rahim Noor in the police lock-up at the Malaysian National Police Headquarters in Bukit Aman, Kuala Lumpur.



Yesterday, Judge Komathy had allowed the prosecution’s application to issue a gag order to restrain the media from reporting about Abdul Gani Patail's alleged involvement as shown in the contents of the exhibits.

The prosecution team in Anwar Ibrahim's sodomy trial suffered a setback when the High Court rejected its application to review a decision by the Sessions Court to hear the merits of a prosecution application to transfer the case to a higher court.

Judge rules that Anwar's sodomy case arguments to be heard in Sessions Court

Sessions Court judge SM Komathy Suppiah ruled against the prosecution's application to transfer Opposition leader Anwar Ibrahim's second Sodomy trial to the High Court. She will hear arguments regarding the application in the afternoon.

The judge said that the lower court has the jurisdiction to hear the case, regarding the transfer to a higher court, her decision is a significant victory for Anwar's defence team.

Anwar had objected to the application to transfer the case to the High Court because it was made by the Attorney-General Abdul Gani Patail, who has been accused by Anwar of evidence tampering in an earlier case.

Anwar, a former Malaysian DPM is charged with sodomising his former aide Mohd Saiful Bukhari Azlan.

The honourable judge has upheld the cause of justice in Malaysia, this is indeed a spark of hope.

Justice, democracy and human rights, which are sorely lacking under the UMNO / BN federal government, are still being kept alive until the new Pakatan Rakyat (Peoples Alliance) federal government comes to power.

UPDATE

The sessions Court will resume on Wednesday, 8th October 2008, at 11:00 when the defence will continue submissions objecting to the transfer of the sodomy case to the High Court.

Why was Mohamad Saiful Bukhari Azlan Not Charged as well?

Anwar Ibrahim has been charged under Section 377B of the Malaysian Penal Code, which reads:

"Whoever voluntarily commits carnal intercourse against the order of nature shall be punished with imprisonment for a term which may extend to twenty years, and shall also be liable to whipping."

I understand that this his means Anwar is charged for consensual (voluntary) anal sex (buggery), not for rape, assault or forced anal sex.

Anwar Ibrahim questioned why he was the only one brought to court if he was supposed to have had committed a consensual unnatural sexual act with his former aide, Mohamad Saiful Bukhari Azlan according to Malaysiakini

“If it is consensual, why was I the only one being charged?"

"This is a political persecution,” he was reported to have said after he is released on a RM20,000 personal bond.

Parti Keadilan Rakyat de facto leader Anwar Ibrahim was charged with sodomy at the Sessions Court in Kuala Lumpur this morning, a move that may perhaps damage his chances of a political comeback.

Anwar pleaded not guilty and claimed trial to the charge of committing carnal intercourse against the order of nature with his former aide, Mohamad Saiful Bukhari Azlan, 23 years of age.

Sessions court judge SM Komathy Suppiah set 10th September 2008 as the date for mention of the case.

Anwar, 61 years old, allegedly committed the offence at unit 11-5-1 Desa Damansara Condominium, No 99, Jalan Setiakasih, Bukit Damansara, Kuala Lumpur between 3.01pm and 4.30pm on 26th June 2008

The charge was made under section 377B of the Penal Code, it carries a maximum 20 years jail and whipping upon conviction.

Anwar was released on a personal bond of RM 20,000 which will allow him to contest the upcoming Permatang Pauh by-election on 26th August 2008.

The opposition alliance Pakatan Rakyat said in a statement that it would formally propose him as their leader if he won the Permatang Pauh by-election.

"I feel good, thank God," Anwar reportedly had said to a Reuters reporter after the court decision.

The Jalan Duta court complex was surrounded by about 300 policemen, some in riot gear, many roadblocks were set up in Kuala Lumpur, apparently to prevent a possible repeat of protests involving thousands of people staged 10 years ago when Anwar faced similar charges. The roadblocks caused the public to be intimidated, inconvenienced and delayed in massive jams starting from before 07:00.

More than one hundred supporters shouting "reformation" and "long live Anwar" gathered outside the court complex.

A guilty verdict would effectively end the political career of Anwar Ibrahim, a man who has long aimed to play a decisive role in Malaysian politics and who was only allowed back into politics in April after his release from prison in 2004.

Seats in the sessions court room were limited to only one reporter from each news media / news agency and only the chosen reporters were allowed to enter the courtroom.

Anwar Ibrahim arrived at the centralised Kuala Lumpur courts complex in Jalan Duta at about 09:45 today, Thursday, 7th August 2008.

He is expected to be charged at about 10:00, with sodomy, in the Sessions Court.

The KL court complex has been inundated since about 06:00 with a massive police presence, including Federal Reserve Unit (Riot Police), unformed policemen as well as the CID in plainclothes, as well as the police special branch

Anwar's supporters have been assembling, and their numbers have been steadily growing at the court complex since before daylight.

Police roadblocks set up on all roads leading to Jalan Duta, and the KL court complex and the surrounding areas, this has caused massive jams, which are intimidating and delaying people heading to work and sending their children to school.

What a shameful situation there is in today's Malaysia.

Anwar Ibrahim to be charged on Thursday, 7th August 2008, for sodomy.

The police issued a summons to Anwar Ibrahim today, 6th August 2008, the very same day that the Election Commission announced the dates for the nomination (Saturday, 16th August 2008) and poll (Tuesday, 26th August 2008) for Permatang Pauh by-election, in which Anwar will contest.

Anwar is required to attend the Sessions Court in Kulaa Lumpur at 10:00 Malaysian Time (GMT +8) tomorrow, Thursday, 7th August 2008.

charge Anwar Ibrahim with sodomy,
said former US vice president Al Gore today.'


The charges could perhaps be made under these outdated, prudish, draconian and oppressive laws:

Section 377A or Section 377C of the Malaysia's Penal Code.

Section 377A covers carnal intercourse against the order of nature and carries a maximum of 20 years' jail and whipping.

It reads as follows:

"Any person who has sexual connection with another person by the introduction of the penis into the anus or mouth of the other person is said to commit carnal intercourse against the order of nature."

Section 377C reads:

"Whoever voluntarily commits carnal intercourse against the order of nature on another person without the consent, or against the will, of the other person, or by putting the other person in fear of death or hurt to the person or any other person, shall be punished with imprisonment for a term of not less than five years and not more than 20 years, and shall also be liable to whipping."

Sections 377A and 377C are both non-bailable offences.

However, under Section 388 of the Criminal Procedure Code, the court has the discretion to grant bail.

"ISSUED FOR IMMEDIATE RELEASE —

6 AUGUST 2008,

PETALING JAYA, MALAYSIA

This morning the Malaysian Election Commission announced nomination and polling day for the by-election that I will contest in Permatang Pauh. I look forward to the campaign period to meet with voters in my home constituency. I invite all Malaysians to join me in this historic campaign to bring forth a New Dawn for Malaysia as we work together to build a more peaceful and prosperous nation.

At the same time we would reiterate our longstanding concerns about the integrity of the electoral process. To this date, the evidence of phantom voters and ballot box stuffing has yet to be addressed by the Election Commission. The poor handling of the use of indelible ink in the General Elections gives all Malaysians, particularly those in Permatang Pauh, reason to be concerned about the conduct of polling this month. I urge the Election Commission to take this opportunity to restore some credibility to its reputation by fulfilling its constitutional mandate to ensure that voting is fair and unbiased.

On a darker note, I regret to say that I fear an enormous injustice is about to be perpetrated upon the Malaysian people, worse than those actions taken in 1988 and 1998 which rendered almost irreparable harm against the institutions of democracy and the rule of law. While some individuals suffered greatly by those actions, the Malaysian people have been the greatest losers.

Tomorrow I will be charged with a crime I did not commit. The real criminals will, in their efforts to humiliate me and to derail the people’s aspirations for transformational change in Malaysia, hide behind a smokescreen created by the government controlled mainstream media.

This travesty of justice will take place. It will happen with the active support and the criminal involvement of the highest echelons of the police and politicians—including the office of the Prime Minister.

We have been informed that the Attorney General’s chambers has advised against charging me after having studying the investigation papers. Despite its views, some individuals within the Police have insisted on pursuing this case even though the legal professionals in the AG’s Chambers take a different view.

The evidence proves that the accuser lied in his initial report. He has been seen to be working in close collaboration with the police, notably his meeting with SAC2 Rodwan who was working hand in hand with Musa Hassan to conspire against me in 1998. Other witnesses in this matter have been threatened and harassed in order to fabricate evidence. Doctors appear to have been pressured to violate all norms of medical ethics. Senior Ministers, in their comments about the case, have demonstrated their consistent interference in the investigation.

We are also informed that some individuals within the Prime Minister’s close circles are adamant about pursuing this case. Their involvement further undermines the credibility of the case and proves that the entire conspiracy hatched against me is politically motivated.

Today the Prime Minister faces a crisis of confidence. His approval ratings have plummeted since the March elections and senior members of the Barisan Nasional have joined Pakatan Rakyat in droves. The economy under his abysmal management has reached its lowest ebb in decades and all signs point to further weakening. And just yesterday prominent UMNO members have initiated an investigation into his own involvement in corruption and money politics. This is a man under siege – and he sees no way out but to deflect the attention of the Malaysian people with a sham trial against me.

He is now burning the forest to save his own tree!

I have thus far constrained my criticism of the Prime Minister to his failed policies and general incompetence in leading the nation. But now it is clear that his vendetta against those who would seek his early dismissal from office knows no boundaries and will transgress all limits of the rule of law.

I hold the Prime Minister personally responsible for the damage that is about to be done to the nation and to the integrity and dignity of the Malays.

Our international standing, recently lambasted by prominent leaders from around the world, will plummet even further. Overseas investors are already deeply skeptical about Malaysia on account of its reputation for deeply engrained corruption and economic inefficiency. They will certainly be further dissuaded from any further activity in Malaysia. The continued decline in the economy will lead to greater unemployment and rampant stagflation.

I will fight this with the hope and energy of the people who have supported reformasi in Malaysia. I will not allow this cowardly attack to derail Pakatan Rakyat’s agenda for change. Insha’Allah we will win in Permatang Pauh. Insha’Allah we will win convincingly. I look forward to joining my colleagues in the Parliament to prepare for the historic transition that the country is eagerly awaiting.
