SOME EXTRACTS:

“Freedom of expression and freedom of assembly are still restricted for government critics. Najib and his ministers defend preventive detention and outdated repressive laws in the name of public security and a fragile multi-ethnic society.”

“The Internal Security Act permits indefinite detention, without charge or trial, of anyone officials regard as a threat to national security, such as suspected terrorists, individuals allegedly promoting ethnic or religious divisiveness, and government critics.”

“Stepped-up arrests, combined with fewer deportations, have increased overcrowding in immigration detention facilities and produced a deterioration of already abysmal living conditions, including contaminated water supplies, inadequate access to medical care, and poor and insufficient food “

“Public rallies organized by government critics are routinely denied permits, while those supportive of government positions may proceed unencumbered even without the requisite permit.”

“The 1984 Printing Presses and Publications Act acts as a censor by requiring annual renewal of publishing licenses and by controlling production and distribution of foreign publications. In August 2009 the government confiscated copies of the inaugural issue of Gedung Kartun, a political satire magazine, on the questionable grounds that it had not yet received a permit. The issue's cover satirized Najib's alleged indiscretions.“

“Malaysia's dual-track legal system permits Sharia courts to rule on religious and moral offenses involving Muslims and on issues involving marriage, inheritance, divorce and custody battles, and burial rites, many involving inter-religious disputed claims.”

“In July 2009 the Sharia High Court in Pahang state sentenced Kartika Sari Dewi Shukarno to six strokes of a cane for drinking beer in a nightclub.”

“Malaysian authorities continue to harass and arrest human rights defenders including lawyers, journalists, NGO activists, opposition politicians, and even outspoken members of Suhakam, Malaysia's official human rights watchdog.”

“The US Trafficking in Persons 2009 report downgraded Malaysia to Tier 2 for its failure to adequately combat human trafficking. After Senator Lugar's report the head of the US Office to Monitor and Combat Trafficking in Persons welcomed the arrests of immigration officials, but said the US wants to see "sustainability" and court cases.”

Did you take special note of the hateful, ultra racist remarks and nonsensical comments make by Mohd Khairul Azan bin Abdul Azam, Chairman of the Pro ISA Movement.

Such extremist sentiments and radical expressions of racial supremacy by the likes of him are much more dangerous to Malaysia than anything else!

But will he be punished or disciplined? He most certainly should be, but of course he most probably will not, as he must be an UMNO-ite!

Three Months of Najib!

The PM & DPM ++ and rent-a-crowd, doing the 1Malaysia Shuffle!

After three months of Najib as PM, what has substantively changed for the better in Malaysia?

The short answer is absolutely nothing.

There have been a heaps of verbal diarrhoea, bags full of hot air, lots of funny hats and ridiculous costumes worn, even dodgy dance routines, but really and truly there seems to have been no substantive progress towards ending overt racism, ensuring equality for all citizens, respecting freedom of speech, freedom of information, freedom of expression and human rights.

Malaysia has been afflicted by many multifarious mishaps over the last three months, buildings and roads have collapsed, controversies have been seen to increase, diseases such as malaria, leptospirosis and meningitis have blossomed, the Internal Security Act 1960, Emergency Ordinance (Public Order and Crime Prevention) 1969, Sedition Act 1948, Printing Presses and Publications Act 1984 and many other archaic and draconian laws are still on the statute book, the Police Act also remains unchanged.

Politics seems to be getting dirtier than usual; whilst UMNO / BN show no signs of reinventing themselves for the better.
However, with the main stream media seemingly more under the thumb than ever nowadays, things may actually be even worse than they are reported, who knows.

Now in 2009, almost at the end of the first decade of the 21st Century, people can still be locked up without any judicial process, effectively guilty without trial.
How utterly shameful in what is touted as being a democratic country!

Harry Lee has come and gone after his extra warm welcome (excepting Dr. M), extensive exploration of the just the peninsular part of Malaysia, and his resulting insolent critique.

The superstitious may be forgiven for even believing there is a national curse which seems to have started when Najib became PM on 3rd April 2009.

Now in the second half of 2009, will Malaysia progress, further decline or simply stagnate under the stewardship of Najib?

Let's wait and see!!

The people of Malaysia are a patient lot, but even patience has a limit!

ISA Scheme

I Smell A Scheme

Singapore’s most wanted men, Mas Selamat Kastari, who was detained in Skudai, Johor State, Malaysia in April 2009, is now reported to be held for two years under the Malaysian Internal Security Act (ISA).

“Mas Selamat is now incarcerated by virtue of a stroke of the pen two-year detention order at the infamous Kamunting Detention Centre in Taiping, Perak” sources evidently told the Malaysia National News Agency (BERNAMA) on Wednesday 27th May 2009.

Mas Selamat, the Jemaah Islamiah (JI) leader of the Singapore chapter escaped from a maximum security detention centre in Singapore in February 2008, and eventually was apprehended in Malaysia

According to the sources, the detention would mean that the alleged Singaporean militant would not be extradited to the Republic of Singapore.

It is also understood that an ordinary JI member, Abdul Matin of Ulu Tiram, who was picked up in April, is also being held for two years under ISA.

Malaysia's Prime Minister Najib Razak reportedly said that

'Mas Selamat was being detained under the ISA because he was considered a threat to the national security of both Malaysia and Singapore'.

Well, all this seems very strange, something really stinks here, most likely Malaysia is using the ISA detention to try to justify the continued existence of the archaic, oppressive, draconian and inhuman ISA, which in practice allows indefinite detention, in what can only be described as 'atrocious conditions', without trial.

This is because it is seen by some as a useful tool to intimidate and oppress the citizens, something akin to a 'Sword of Damocles'

In this case it is, of course, being used against a 'terrorist', but all too often in the recent past it has been used against political foes and others who have committed no crime.

THE ISA SHOULD BE REPEALED!

Surely if Malaysia does not want to hand this man back to Singapore, he could be detained under other laws instead of the ISA.

SHAME ON THE PM AND MALAYSIA'S FEDERAL GOVERNMENT!

RKP to be freed later today, what about all the others detained without trial in Malaysia

It is indeed very good that RPK is to be released from unlawful detention under the ISA, but there are many more people under detention without trial in Malaysia, under the ISA, Emergency Ordinance, and other oppressive, draconian and undemocratic laws.

Until such laws are repealed, and unless all those detained without trial are released, the candlelight vigils, and the peaceful gatherings to protest against them should continue.

The US has new new President Barak Obama who heralds a new beginning and a change for the better for the United States and even the whole world.

In Malaysia, change is long overdue, now is the time for this change.

All those who are eligible to vote, but have not yet registered to vote, please do so as a matter of utmost urgency.

At the next general election, you can make a difference.

Those who do not vote, or who have not registered as a voter and thus cannot vote, may make all the difference between a victory for Pakatan Rakyat and change, or more of the same BN style oppression.

INSIST ON JUSTICE AND DEMOCRACY IN MALAYSIA

RPK TO BE FREED TODAY

WONDERFUL NEWS

Malaysia Today editor Raja Petra Kamaruddin is to be freed today 7th November 2008.

Raja Petra Kamarudin was successful in his bid to obtain a release order from detention under the Internal Security Act (ISA) via a habeas corpus application.

The judge ruled that the Home Minister (Hamid Albar) had acted outside his jurisdiction when he issued the two-year detention order under Section 8(1) of the ISA.

The High Court in Shah Alam also allowed Raja Petra to be brought to court to be released today.

He was detained under the archaic and draconian ISA for a second time on 12th September 2008.

One small step for justice, one small step for democracy in Malaysia.

The Home Affairs minister Hamid Albar should be sacked immediately.

Malaysian government has no plan to review the ISA, so says Abdullah Badawi

Read the extracts of the BERNAMA report below

Government Has No Plan To Review ISA At The Moment, so says PM on Saturday afternoon, 18th October 2008.

The Malaysian government has no plan to review the Internal Security Act (ISA), at least for the moment, Prime Minister Abdullah Badawi said today.

He said the law was still being used and there was no discussion pertaining to its status as yet.

He said the ISA was still relevant in today's context, and that even many other countries were also enacting similar laws now for security reasons.

"ISA is not legislation that cannot be applied. Such legislation is also applied by other countries.

"Countries which do not have the ISA now feel that it is proper to have such legislation, countries such as the United States and England," he said.

He said it was important to exercise caution in executing the law. "There has been no element of abuse of power," he said.

On the call from various quarters, including political parties, for the government to release all ISA detainees, Abdullah said the matter was under the jurisdiction of the Home Ministry.

"I have no other comments. He (Home Minister, Hamid Albar) understands the situation better, whether to release or continue with their detention," he said.

When asked if it was timely for such a move considering that he was embarking on a reform platform, Abdullah answered:

"So what? Reform is reform, law is law. Detainees are detainees. Reform does not mean we want to reform everything, everything in the law, undoing offences."

The ISA, which allows for indefinite detention without trial, has long been the subject of controversy, this was highlighted recently when several people, including a newspaper reporter, an MP and and blogger Raja Petra Kamarudin were detained under the draconian Act.

Interesting talk, but the PM is being superficial, rather shallow, seems to be insincere and is presenting incomplete arguments.

In reality, the ISA was formulated to combat armed terrorists and insurgents at the time Malaysia was under the period of confrontation from the communist threat; it is undoubtedly now being misused to oppress and to silence political opposition.

ANOTHER ARREST UNDER ISA - UPDATE

UPDATE:

JUSTICE IS DONE

SUARAM (Suara Rakyat Malaysia) member Cheng Lee Whee, 26, was released on Saturday 18th October 2008, after the Magistrate's Court in Kuala Lumpur rejected a police application for her remand.

Cheng had been arrested under the ISA on Friday for posting a statement on the State police web portal which allegedly could cause fear among the public.

SUARAM member has been detained under the wicked ISA over a police report regarding the demolition of a squatter colony.

Once again it appears that the ISA has been used in a minor case which could have been dealt with using laws which are far more appropriate than the draconian ISA!!!!

A lady aged 28 years has reportedly been arrested at 22:00 hours last night under Section 28 of the Internal Security Act (ISA) for allegedly disseminating false information concerning the demolition of a squatter colony in Kampung Baru Plentong Tengah, near Johor Bahru.

Section 28 of the ISA concerns the dissemination of false reports, according to this section,

“Any person who, by word of mouth or in writing or in any newspaper, periodical, book, circular or other printed publication or by any other means spreads false reports or makes false statements likely to cause public alarm, shall be guilty of an offence.”

According to lawyers, section 28 of the ISA does not empower the police to detain a suspect without trial.

The suspect must be brought to a court within 24 hours, either to be charged, or be further remanded to facilitate police investigation.

The police are expected to apply for a remand order today (Saturday 18th October 2008,) to 'facilitate their investigations'.

The woman is alleged to have lodged a false police report regarding the incident on Thursday, 16th October 2008, she also is said to have sent an e-mail, to the Johor police website, which claimed that the police had abused their powers and used water cannon to disperse the crowd who were protesting the demolition.

Initial investigations seemingly revealed that the woman, Cheng Lee Whee, was not present at the scene.

Johor State Chief Police Officer Deputy Commissioner of Police, Mokhtar Mohd Shariff has confirmed the arrest.

Once again, it appears that, the evil and draconian ISA is been utilised as a 'weapon' to try to subdue the people, and make them totally subservient to those who are in power.

Malaysia Today blog website denounces money politics, ethnic polarisation and advocates transparency, accountability and justice

During his testimony on the first day of Raja Petra’s trial under the Sedition Act, Malaysian Communication and Multimedia Commission’s director for Security, Trust and Governance department Harme Mohamed said that the Malaysia Today blog website denounced money politics, ethnic polarisation and advocated transparency, accountability and justice.

The UMNO / BN Malaysian government seems not to like those who oppose money politics, ethnic polarisation and those who advocate transparency, accountability and justice, as it tries to silence patriots, like RPK, by using the Internal Security Act and the Sedition Act against them.
